Right of withdrawal

Pursuant to the following instructions on withdrawal, you only have a right of withdrawal if you are a consumer. A consumer is any natural person who concludes a legal transaction which, to an overwhelming extent, cannot be attributed to either their commercial or independent professional activities.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without specifying any reasons.

The withdrawal period is 14 days with effect from the day,

• on which you or a third party nominated by you, who is not the carrier, have taken possession of the goods, provided you have ordered one or more goods within the scope of a single order and these goods are delivered together;
• on which you or a third party nominated by you, who is not the carrier, have taken possession of the last item of goods, provided you have ordered several goods within the scope of a single order and these goods are delivered separately;
• on which you or a third party nominated by you, who is not the carrier, have taken possession of the last partial delivery or the last item, provided you have ordered goods which are delivered in several partial deliveries or items.

To exercise your right of withdrawal, you must inform us

by means of a clear declaration, for example a letter sent by post, telefax or email, of your decision to withdraw from this contract. You may use the model withdrawal form for this purpose, but this is not mandatory. The model withdrawal form is available as a PDF here online.

You can also exercise your right of withdrawal online by clicking the “Vertrag widerrufen” button in the footer of our website www.nakatanenga.de. If you use this online function, we will immediately send you a confirmation of receipt on a durable medium, for example by email, with information about the content of the withdrawal declaration and the date and time of its receipt.

In order to meet the withdrawal deadline, it is sufficient for you to send the notification about exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall repay all payments we have received from you, including the delivery costs, with the exception of any additional costs resulting from the fact that you selected a type of delivery other than the cheapest standard delivery offered by us, without undue delay and at the latest within 14 days from the day on which we receive your notification of withdrawal from this contract.

For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within 14 days from the day on which you inform us of the withdrawal from this contract.

The deadline is met if you send the goods before the period of 14 days has expired.

You bear the direct costs of returning goods that can be shipped by parcel as well as the direct costs of returning goods that cannot be shipped by parcel. The costs for goods that cannot be shipped by parcel are estimated at a maximum of approximately EUR 120.

You must only pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking the condition, features and functionality of the goods.

Criteria for exclusion or expiry

The right of withdrawal does not apply to contracts

• for the supply of goods that are not prefabricated and for whose manufacture an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
• for the supply of goods that can spoil quickly or whose expiry date would be exceeded quickly;
• for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

• for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
• for the supply of goods if these have been inseparably mixed with other goods after delivery due to their nature;
• for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
